LTD., its subsidiaries and Affiliates (collectively “BriefTech”, “we”, “us” or “our”) may collect, use, disclose or otherwise process personal data and information relating to You when You visit our Website or use our Services in compliance with the Singapore’s Personal Data Protection Act 2012, Hong Kong’s Personal Data Privacy Ordinance (Cap. 486) and Malaysia’s Personal Data Protection Act 2019 (“PDPA”). This Privacy Policy applies to personal data in the possession or under the control of BriefTech, including any other legal entities or service providers that BriefTech may engage to collect, use, disclose or process personal data for the purposes of BriefTech in delivering its Services to you. This Privacy Policy forms part of the terms and conditions, governing Your specific relationship with BriefTech. In the event of any conflict or inconsistency between the provisions of this Privacy Policy and the General Terms, the General Terms shall prevail to the fullest extent permissible by law. Capitalized terms not defined in this Privacy Policy have the meanings given to them in the General Terms.

 

1.2.        Acknowledgement and Consent - By interacting with us, visiting our website http://brieftech.ai (“Website”) or accessing the Service, You acknowledge and agree that You accept the practices, requirements, and/or policies outlined in this Privacy Policy, and You hereby consent to us collecting, using, disclosing and/or processing Your personal data as described herein.

 

1.3.        Amendments - We may revise or update this Privacy Policy at any time by posting a revised version on our Website. You are advised to periodically view our Website for any updates or the most current version of our Privacy Policy. Your continued visit our Website or accessing of the Service indicates Your agreement with the revised or updated Privacy Policy.

 

1.4.        Withdrawal - You may withdraw Your consent at any time by contacting the Data Protection Officer based in Singapore at the following address [email protected] and by terminating Your use of our Services.

 

2.     PERSONAL DATA WE COLLECT

 

2.1.        Collection of Personal Data - In using our Services or accessing our Website, You may be asked, may have supplied any information to establish Your identity. The types of personal information we collect depends on the circumstances in which the information is collected. The types of personal information we collect may include:

 

2.1.1.     Your name and contact details, including email, address, mailing address and mobile number;

2.1.2.     Identification details, such as date of birth;

2.1.3.     Who You work for and Your position;

2.1.4.     Your occupation;

2.1.5.     Information regarding Your use of or interest in our products and services;

2.1.6.     How You make payments to us in any transaction, such as payment details. This could include bank account and debit or credit card details;

2.1.7.     Your transaction history with us;

2.1.8.     Records of communications and dealings with you, such as emails, SMS, telephone, and in-person communications;

2.1.9.     Information regarding Your use of our Website or Services, including how many documents You upload, what type of documents You upload and who You share documents with;

2.1.10.  Information we may collect as part of a survey, customer feedback request or a competition;

2.1.11.  Information that You provide to us, for example, for verification purposes or as evidence in respect of a complaint; or

2.1.12.  Other information that You provide to us during the course of business.

2.2.        Employees - For our employees, employee records that may contain Personal Data including safety information (e.g. location information, emergency contacts) and travel and right to work information (e.g. copies of passports and visas) and information to pay wages.

 

2.3.        Suppliers - We collect information about people who are our suppliers and business partners, or who are employed by our suppliers and business partners. The information we collect is that which we need to do business with that party.

 

2.4.        Provision of Personal Data of Other Individuals - To the extent that You have provided, or will provide, Personal Data about you, Your client, Your family members, spouse, other dependents (if You or Your clients are an individual), directors, shareholders, employees, representatives, agents (if You or Your clients are a corporate, an entity or an organisation) and/or other individuals, You confirm that You have explained or will explain to them that their Personal Data will be provided to, and processed by, us and You represent and warrant that You have obtained their consent to the processing (including disclosure and transfer) of their Personal Data in accordance with this Privacy Policy.

 

2.5.        Control & Ownership of Uploaded Data -  When You use our Services, You can use the features of the Services to control how You share and delete information. We do not consider that the Confidential Information or P&C Data that You upload to the Service is our information and we do not review or access the content of that information, unless You instruct us to do so (for example, to solve a technical issue). If the information that You upload to the Service contains personal information or Personal Data, we do not collect or use that personal information other than for the purpose of delivering the Service to you. When You share a matter, file or document with another person, it is You that is disclosing that matter, file or document, not us, and accordingly You need any appropriate rights and permissions to do so.

 

2.6.        User’s Choice - You have the choice, at any time, not to provide Your Personal Data to us, however, failure to provide Your Personal Data and any Information to us may result in BriefTech being unable to provide You with its products and Services. We do not knowingly collect information from or direct any of our content specifically to children under the age of 18. If You are under 18 years of age, please do not provide Your personal information to us.

 

3.     ONLINE SERVICES

 

3.1.        Collection of Information – When using our online Services and Website, our system may automatically collect information about You and how You use our online services. We may collect information such as:

 

3.1.1.     User names and passwords that You create to access the Service;

3.1.2.     Which services You use and how You use them;

3.1.3.     Which pages You visit on our Website;

3.1.4.     Device information, such as the model and ID of the device You use, operating system, telephone number and mobile phone network;

3.1.5.     Server log information, such as details of how You used the service, IP address, hardware settings, browser type, browser language, the date and time of Your use and referral URL;

3.1.6.     Information that may uniquely identify Your browser or Your account;

3.1.7.     clickstream to, through and from our Website;

3.1.8.     products You viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs) and methods used to browse away from the page; and/or

3.1.9.     Location information and time zone settings.

3.2.        Other Information Collected - We may use publicly available sources to approximate Your geographic region and Internet Service Provider based on Your IP address. We may use Your IP address or domain name for internal traffic monitoring and capacity management purposes or to otherwise administer our website and platform. No personal information is obtained, rather the patterns and usage of our Website and Services may be tracked for the purposes of providing improved service and content based on aggregate or statistical review of user traffic patterns.

4.1.        Purpose - We may use Personal Data and Personal Information held for legitimate purposes associated with BriefTech’s business, including but not limited to any or all of the following purposes ("Permitted Purposes"):

4.1.3.     To recommend or consider Your eligibility for our Services;

4.1.4.     To improve our Services and/or develop, research, design and launch new features, products and Services, operational and business processes;

4.1.5.     To provide You with customer support and to provide You with information about our Services and how to use Your Services;

4.1.6.     To process payments,

4.1.7.     To monitor and detect possible fraud or breaches of our General Terms and conditions of service;

4.1.8.     To enforce the terms and conditions of any agreement between You and BriefTech including to collect payments from You (and including this Privacy Policy);

4.1.9.     To ensure that You and Your account with us complies with all relevant laws and Your contractual obligations to us;

4.1.10.  To keep You informed about our Services including its alerts, notification, updates, via email, messaging, phone, social media or any other channel;

4.1.11.  To respond to Your request or questions or to provide information when You contact us or make a request to us;

4.1.12.  To allow You to participate in interactive features of the Website and Services, when You choose to do so;

4.1.13.  To carry out our planning and forecasting activities;

4.1.14.  To conduct research and statistical analysis and surveys with the aim of improving our products and Services and product development;

4.1.15.  To compare information/data for accuracy of our record, and to verify the same with third parties;

4.1.16.  To utilise the same for our outsourcing of business and backroom operations;

4.1.17.  For security purposes, including to perform functions that we believe are necessary to protect the security and proper functioning of our website and our platform

4.1.18.  To investigate or respond to incidents and complaints and/or to comply with investigations carried out by the police, government or regulators or legal proceedings, including seeking professional advice;

4.1.19.  to administer surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners;

4.1.20.  to make special offers related to our products and services;

4.1.21.  to gain an understanding of Your needs to provide You with better and more personalised products and services tailored to Your requirements;

4.1.22.  to promote and market our products;

4.1.23.  to maintain and update our records;

4.1.24.  To comply with any legal obligation and where required under any applicable laws; and/or

4.1.25.  For such purposes directly related to or incidental to the above or as authorized by you.

 

4.2.        Non-Exhaustive List - You acknowledge, agree and consent to the processing of Your Personal Data and Personal Information depending on the circumstances at hand for such purpose that may not appear as a Purpose. However, we will notify You of any such other Purpose at the time of obtaining Your consent, unless processing of the applicable data without Your consent is permitted by the applicable laws.

 

4.3.        Third Party Use - We may also use Your data, or permit selected third parties to use Your data, to provide You with information about goods and services which may be of interest to You and we or they may contact You about these by email, post or telephone.

 

4.4.        De-identify information - We may de-identify information about an individual or business so that the information can no longer be related to that individual or business. We may then use and disclose that de-identified information in the course of our business. We may also aggregate information on the use of our Website and Services in such a way that the information can no longer be related to the specific individuals or businesses. We may then use and disclose such aggregated information in the course of our business (including in any promotional or marketing material).

 

5.     DIRECT MARKETING & UNSUBSCRIBE

 

5.1.        Marketing - We may use and disclose Your Personal Data and Personal Information to carry out market and product research, compile demographics and perform other analysis so that we can develop and implement initiatives to improve our products and services. We may use and disclose Your Personal Data and Personal Information for marketing purposes or to conduct events (such as CLEs). We will only provide You with direct marketing materials where You would reasonably expect us to, or if You consent to receive direct marketing materials. If we have obtained Your Personal Data or Personal Information from a third party, we will seek Your consent to provide You with direct marketing materials. Direct marketing communications may include promotional material about us and the Service we provide, and topical legal issues. We may also contact You about other products or services or special offers we think may be of interest to you. This information may be sent to You by email, SMS or by other means.

 

5.2.        Research - We may use and disclose Your Personal Data and Personal Information to carry out consumer and market research, compile demographics and perform other research and analysis so that we can develop, design and implement initiatives to improve our Services and Website..

 

5.3.        Opt-out - You can opt-out of receiving marketing communications from us at any time by following the ‘unsubscribe’ link in the communication or contacting us. If You unsubscribe from marketing communications, this will not stop You receiving service-related communications from us if we are otherwise legally entitled to send them to you, such as administration alerts about Your account.

 

6.     DISCLOSURE AND TRANSFER OF DATA

 

6.1.        Instances of Disclosure - Your Personal Data held by us shall be kept confidential at all times. However, in order to provide You with effective and continuous products and Services subject to any laws, regulations and guidelines and for the Permitted Purpose, we may need to disclose Your Personal Data to the following parties:

 

6.1.1.     BriefTech’s agents, holding companies, subsidiaries, affiliates, associates and “related corporation” as defined under the Companies Act (Cap. 50) of Singapore;

6.1.2.     Your employer for example if You have a Law Firm account;

6.1.3.     other users of our Service, including barristers, advocates, solicitors, clients, experts and judges so that they may use the platform to contact You or to share documents with you, or so that You may use the Service to share documents with them;

6.1.4.     to our commercial partners in any product or service offering;

6.1.5.     any governmental agency or regulatory authority of any jurisdiction properly exercising its powers;

6.1.6.     professional advisers, consultants, contractors, service providers and our other agents with whom we have contractual agreements for some of our functions and services or who assist us in operating our business (for example to payment service providers, customer analytics providers, mail house operators, banks, investigators and organisations that we engage to deal with You on our behalf);

6.1.7.     parties providing services and/or products to BriefTech (including information technology services, auditors or compliance services providers);

6.1.8.     strategic/business partners with whom we have or may have a relationship with for specific products and services;

6.1.9.     insurance companies;

6.1.10.  to any third party where we consider that disclosure of Your data to such third parties will be necessary to fulfil legitimate business interests;

6.1.11.  entities that BriefTech is in discussions with for a merger or an acquisition of BriefTech by such other entities;

6.1.12.  entities that acquire the assets of BriefTech pursuant to any applicable law, including the laws of insolvency in Singapore;

6.1.13.  entities pursuant to any order of court from a court of competent jurisdiction;

6.1.14.  any person connected to the enforcement or preservation of any of our rights under Your agreements with us; and/or

6.1.15.  any party authorised and/or consented by you.

 

6.2.        Third party services - You can choose to connect Your account on our platform with third-party services, for example a third party document management system. By doing so, You are enabling us and those third parties to exchange information about You and data in Your account. All third parties’ use of Your information will be governed by their own privacy policies and terms of service.

 

6.3.        Administrator - If You are a user who is part of a Law Firm Account, Your administrator may have the ability to access and control Your account. Please refer to Your organisation’s internal policies if You have questions about this.

 

6.4.        Sharing Access of Matter Folders - If You join a shared folder or managed matter (or otherwise access content or P&C Data that has been shared with You by another), that other user members of that user’s organisation or law firm may be able to view information about You (such as Your name and email address; Your IP address) and Your use of what is shared. If You upload or share content with another user to a matter in the Service, then others who have access to that matter may have the ability to access, share and edit what You share. If You share content with a user who is part of a law firm or other organisation, the administrator of that account may have the ability to access and edit what You share.

 

6.5.        Data Protection in Countries Not Including Singapore - The Personal Data that we collect from You may be transferred to, and stored at, a destination outside Singapore. It may also be processed by staff operating outside Singapore who work for us or one of our suppliers. Such staff may be engaged in, among others, the fulfilment of the services to be delivered to you, the processing of Your payment details and the provision of support services. The service providers we engage may use international data centres and disaster recovery sites. By submitting Your Personal Data to us, You agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that Your personal data is treated securely and in accordance with PDPA.

 

6.6.        Transmission of Information via Internet - Please note that the transmission of information via the internet is not completely secure. Although we do our best to protect Your Personal Data, we cannot guarantee the security of Your data transmitted to our Platforms and any transmission is made at Your own risk. Once we have received Your information, we will use strict procedures and security features to try to prevent unauthorised access to Your Personal Data.

 

7.     YOUR RIGHTS

 

7.1.        Request for Access - To the extent that the prevailing personal data protection and privacy laws allow, You have the right to request for access to, request for a copy of, request to update or correct, Your personal data held by us. Please note that depending on the request that is being made, BriefTech may only need to provide You with access to the Personal Data contained in the documents requested, and not to the entire documents themselves, in which case it may be appropriate for BriefTech to instead provide You with a confirmation of the Personal Data that our organisation has on record if the record of the Personal Data forms a negligible part of the document.

 

7.2.        Changes to Personal Data - If there are any changes to Your Personal Data or if You believe that the Personal Data we hold about You is inaccurate, incomplete, misleading or not up-to-date, kindly write in to us or email Your request to [email protected] setting out Your name and NRIC/Passport number/Company number, the details of Your request, together with the supporting documents. A fee may be charged for this service. We shall correct or update the information/data as soon as possible. For the avoidance of doubt, we may request information or documents from You to verify Your identity and the authenticity of the request made and any other information relating to the corrections requested.

 

7.3.        Withdrawal of Consent - You have the right, by notice in writing, to inform us of Your withdrawal (in full or in part) of Your consent previously given to use Your Personal Data, subject to any applicable legal restrictions, contractual conditions and a reasonable duration of time for the withdrawal of consent to be effected. However, depending on the extent of Your withdrawal of consent for us to process Your Personal Data, You may not be able to access our Services and/or use our Website.

 

7.4.        Links To Other Platforms - Our Website and Services may, from time to time, contain links to and from the website or platforms of our partner networks, advertisers and affiliates. If You follow a link to any of these platforms, please note that these platforms have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before You submit any Personal Data to these platforms as they may differ substantially from ours.

 

8.     DATA SECURITY

 

8.1.        Data Security - We will take reasonable steps to keep Your personal information safe from loss, unauthorised activity or other misuse. To safeguard personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, BriefTech has introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of personal data by BriefTech, and disclosing Personal Data both internally and to our authorised third party service providers and agents only on a need-to-know basis. Where we have given You credentials which enable You to access certain parts of our Services, it is Your responsibility to ensure that the credentials are kept confidential and that You do not share the credentials with any third party.

 

9.     COOKIES

 

9.1.        Implementation of Cookies - Cookies are small files which are placed on Your computer when a Website is accessed by you. Cookies help the Website user to navigate efficiently between pages and the website operator to track usage of the site. We may link cookie information to Personal Data.
